אִ֛ישׁ אֲשֶׁר־יַעֲשֶׂ֥ה כָמ֖וֹהָ לְהָרִ֣יחַ בָּ֑הּ וְנִכְרַ֖ת מֵעַמָּֽיו׃ {ס}

The instructions for preparing the sacred incense conclude with a strict warning against replicating the mixture for everyday use, much like the restriction placed on the holy anointing oil. The guiding principle is that ordinary people should not use the tools of the King. The instruments and garments dedicated to serving God are reserved exclusively for the sacred realm. For instance, regular people are forbidden from wearing a mixture of wool and linen because this combination was used for the priestly garments. Similarly, one may not build a private home with the exact dimensions of the Sanctuary or craft a personal seven-branched menorah [בכור שור].

A clear warning is issued to anyone who creates this blend, followed by the designated penalty [אבן עזרא]. The core issue is producing the incense for personal pleasure [קאסוטו]. It is not forbidden to simply smell existing incense. Rather, the restriction is against creating a brand new mixture using the exact sacred formula with the intention of enjoying its fragrance [אבן עזרא הקצר]. In fact, the penalty applies the moment the incense is made with this intent, even if the maker has not yet smelled it. The very act of creation for personal enjoyment is the violation [מזרחי].

The primary approach among commentators is that the restriction depends entirely on the creator's intent. A person is allowed to purchase their own materials and prepare the exact formula of the incense, provided it is not for personal enjoyment. They may make it to sell or donate to the public so that it can be burned on the inner altar in the Temple each day [רש״י, מזרחי, ביאור יש״ר, שטיינזלץ]. The fundamental difference lies in respect for the sacred. Producing the incense for personal use degrades holy items, while spending personal funds to prepare the incense for public worship brings honor to the sacred service [ברכת אשר על התורה]. Anyone who violates this boundary and prepares the sacred incense for their own use faces the severe consequence of being cut off from their people [קאסוטו].
