אִ֚ישׁ אֲשֶׁ֣ר יִרְקַ֣ח כָּמֹ֔הוּ וַאֲשֶׁ֥ר יִתֵּ֛ן מִמֶּ֖נּוּ עַל־זָ֑ר וְנִכְרַ֖ת מֵעַמָּֽיו׃ {ס}

A clear boundary is set around the sacred anointing oil, completely removing it from any secular use. It serves as a divine seal, distinguishing and elevating God's chosen leaders. The oil itself represents permanence and superiority, while the fragrant spices mixed into it symbolize the good reputation required of those who guide the nation. When applied, the oil is placed specifically on the head, recognizing it as the seat of the intellect and the body's center of leadership.

To protect this sanctity, duplicating the oil's exact formula is strictly forbidden. The crafting involves a thorough blending process, mixing the materials so that the unique scent can be deeply absorbed into the flesh. Banning the reproduction of this mixture prevents disrespect toward the holy; just as an ordinary citizen would not use a king's scepter for personal matters, one cannot build a private replica of the Temple or the seven-branched Menorah [הדר זקנים, דעת זקנים]. However, the severe punishment for duplicating the oil applies specifically to someone who crafts it with the intention of anointing their own flesh. A person who creates the mixture purely for educational purposes or to hand it over to others is exempt from this penalty [הכתב והקבלה].

It is equally forbidden to apply the oil to an unauthorized person. To incur punishment for this act, a minimum quantity equivalent to the size of an olive must be used [תורה תמימה]. The primary approach among commentators is that this prohibition applies exclusively to the original, historical oil crafted by Moses in the wilderness [רש"י, רשב"ם, מלבי"ם]. Conversely, others maintain that the ban also extends to anyone who anoints with a newly made, secular oil produced using the identical formula [אבן עזרא, קאסוטו].

The identity of the unauthorized "outsider" who is forbidden from receiving the oil depends heavily on context [מזרחי, ביאור יש"ר]. Most commentators agree that an outsider is anyone who does not require the oil for the High Priesthood or kingship. Under this view, kings from the House of David are rightfully anointed as God's chosen [רש"י, רמב"ן, טור, גור אריה]. A narrower perspective argues that an outsider is anyone outside the direct lineage of Aaron the Priest, suggesting that the later anointing of Davidic kings was merely a temporary prophetic instruction rather than the oil's original purpose [אבן עזרא]. Another opinion simply defines an outsider as anyone not explicitly commanded by God to be anointed [העמק דבר]. Questions also arise regarding authorized individuals: does a High Priest or king who is already anointed become an "outsider" regarding further use of the oil? One view suggests they do, and that re-anointing violates the ban [מזרחי]. However, the established ruling dictates that an outsider must be unauthorized from beginning to end, meaning that priests and kings who are anointed again are exempt from punishment [תורה תמימה, משכיל לדוד].

Moses' original oil was meant to remain for all generations as a symbol of eternity and honor. Miraculously preserved throughout history, it was used exclusively for High Priests and the kings of the Davidic dynasty, demonstrating that their authority flowed directly from Moses. In contrast, the kings of the Northern Kingdom of Israel were never anointed with this holy mixture, receiving only standard balsam oil [אברבנאל, פרדס יוסף]. The boundary around the sacred oil is absolute. Anyone who intentionally violates the prohibitions of making or applying it, seizing the holiness reserved for God's chosen, faces spiritual excision—being completely cut off from the people. If a person accidentally commits both offenses, they are required to bring two separate sin offerings, one for each distinct action [תורה תמימה].
