וְשָׁפְט֥וּ אֶת־הָעָ֖ם בְּכׇל־עֵ֑ת אֶת־הַדָּבָ֤ר הַקָּשֶׁה֙ יְבִיא֣וּן אֶל־מֹשֶׁ֔ה וְכׇל־הַדָּבָ֥ר הַקָּטֹ֖ן יִשְׁפּוּט֥וּ הֵֽם׃

The implementation of Jethro's advice completely transformed the justice system of the Israelite camp. What was once a centralized model, with Moses bearing the entire burden alone, evolved into a highly efficient, decentralized network. This marked a significant shift from a theoretical plan to practical, everyday execution, establishing a routine of continuous action [רש"י, חזקוני, ביאור יש"ר, נתינה לגר].

Because such a vast number of officers were appointed, the justice system became accessible at all times. Citizens who previously had to stand in exhausting lines from dawn until dusk now enjoyed immediate and responsive attention [ביאור שטיינזלץ, ברכת אשר]. This newfound availability was so profound that certain financial disputes could even be resolved during the night [ברכת אשר].

The new system distributed authority based entirely on the complexity of the issue at hand. The primary approach among commentators is that once the newly appointed judges mastered the laws of the Torah, the monetary value of a case no longer mattered. There was no difference between a dispute over a massive fortune and a claim for a tiny sum. The sole standard for escalating a case to Moses was the legal difficulty the judges faced in reaching a clear verdict or finding a fair compromise [העמק דבר, מלבי"ם]. An alternative perspective suggests that the difficulty was not always legal, as Moses was also required to personally intervene when dealing with particularly stubborn and stiff-necked individuals [בעל הטורים].

When a case did prove too complex, the escalation process was designed to be as seamless as possible for the people. The litigants themselves were not forced to make the trek to Moses. Instead, the lower judges simply extracted the core, abstract legal question and presented it to him on their behalf [העמק דבר, ברכת אשר].

Even as the lower judges handled the vast majority of the workload, their independence was deeply connected to Moses. The phrasing used to describe their duties subtly blends singular and plural forms, revealing a profound underlying reality. Whenever the judges issued a ruling, their authority was drawn directly from Moses. They judged in his spirit, guided entirely by the principles he had established [רש"ר הירש].

This dynamic was true even for the most difficult cases. When a complex legal question was brought before Moses, he did not conduct a new trial or listen to the arguments of the disputing parties. He merely provided the foundational legal decision to the judges. Armed with his ruling, the judges returned to the litigants to deliver the final verdict. Through this collaborative process, even the most challenging legal dilemmas were ultimately transformed into straightforward matters that the lower judges executed themselves [העמק דבר].
