וְחָצִ֙יתָ֙ אֶת־הַמַּלְק֔וֹחַ בֵּ֚ין תֹּפְשֵׂ֣י הַמִּלְחָמָ֔ה הַיֹּצְאִ֖ים לַצָּבָ֑א וּבֵ֖ין כׇּל־הָעֵדָֽה׃

The division of war spoils reflects a deep principle of national unity and shared privilege. The fruits of victory are not treated as the exclusive property of the soldiers on the battlefield. Instead, the process of distributing the captured assets highlights how the entire nation is interconnected in both effort and reward.

The primary approach among commentators is that the shared spoils refer specifically to living captives and livestock that can be led back from the battlefield [רבנו בחיי, בכור שור, ברכת אשר], though some understand it as a broader category of captured assets [אבן עזרא]. This shared distribution does not apply to movable goods like silver, gold, and clothing. Because the soldiers worked hard to carry these physical items on their shoulders, they are permitted to keep them as private property rather than placing them up for public distribution [בכור שור, ברכת אשר].

The instruction to divide the living spoils does not mean physically placing the assets between two camps. Rather, it requires calculating two exact and equal halves [רש״י, שפתי חכמים, מזרחי, גור אריה]. One half is designated for the military as a special reward for their physical exertion, while the second half is given to the rest of the congregation [ביאור שטיינזלץ, מלבי״ם]. Out of these respective portions, the soldiers are required to separate a tax for the priests, and the civilian congregation separates a tax for the Levites [רבנו בחיי].

The military half is awarded to those who took up arms, accepted the combat mission, and were trained for war [רש״ר הירש, אם למקרא]. This includes every rank within the army, from the highest commanders to the ordinary soldiers [רש״ר הירש]. However, this definition is expanded to include those who did not fight on the front lines but remained behind to guard the camp and the equipment. These guards are granted a status completely equal to that of the active fighters [העמק דבר].

The decision to grant the civilian congregation an equal half of the spoils rests on a complementary view of the nation's effort. The soldiers essentially served as representatives of the entire people [ביאור שטיינזלץ]. Since the war was a campaign of vengeance for an attack directed at all of Israel, it is fitting that the blessing of the spoils is shared by everyone [ספורנו]. Furthermore, the military victory was not achieved solely through the physical strength of the army. The success on the battlefield relied on the merit and prayers of the entire congregation, making the wider public full partners in the campaign who rightfully share in its rewards [מלבי״ם].
