וְעַתָּ֗ה לְכָ֛ה נִכְרְתָ֥ה בְרִ֖ית אֲנִ֣י וָאָ֑תָּה וְהָיָ֥ה לְעֵ֖ד בֵּינִ֥י וּבֵינֶֽךָ׃

After his attempts to justify his actions and shift the blame onto Jacob end in failure, Laban suddenly changes his approach and adopts the role of a peacemaker. He proposes leaving their bitter history behind to form a mutual non-aggression pact for the future [הכתב והקבלה, ספורנו, ביאור שטיינזלץ]. This desire for a treaty also stems from a genuine concern for the safety of his daughters and grandchildren [העמק דבר]. In making this personal appeal, Laban essentially admits that he would not trust any other nation to uphold such an agreement. He places his trust in Jacob specifically because Jacob is a man who serves God [העמק דבר].

A central question arises regarding what exactly will serve as the witness to this new treaty. The primary approach among commentators suggests that the witness is not the agreement itself, but rather God [רש״י, מזרחי, ריב״א, שפתי חכמים, רש״ר הירש]. Laban invites God to act as the supreme judge and observer, overseeing the pact and punishing anyone who dares to violate it [ברכת אשר על התורה].

On the other hand, a different perspective maintains that the covenant itself acts as the witness, bringing a curse upon anyone who breaks it [רמב״ן, רד״ק, הטור הארוך]. According to this view, while God remains the ultimate judge, a human treaty requires the creation of a physical sign for future generations [שד״ל]. This necessitates setting up a tangible object, such as a stone pillar or a mound, to serve as a constant physical reminder of their mutual commitment [רמב״ן, שד״ל, ביאור יש״ר, העמק דבר].

The gathering of these stones carries profound symbolic weight, highlighting a fundamental separation between the two sides. Jacob, embodying the essence of holiness and unity, takes a single stone and establishes it as a pillar. In stark contrast, Laban’s men, who represent forces of impurity and division, gather many scattered stones to form a mound. Ultimately, this treaty and its physical markers are designed to establish a clear spiritual and physical boundary between the Land of Israel and the outside world. It ensures that impure forces cannot cross over to consume what is holy, just as holiness must remain distinct and untainted by impurity [נחלת יעקב].
